C100 FORM
Navigating family disputes can be challenging, especially when the welfare of children is involved. If you're considering applying for a Child Arrangements Order, Prohibited Steps Order, or Specific Issue Order under the Children Act 1989, it's important to understand the steps involved. These applications, typically made using a C100 form, are vital for resolving disputes regarding children’s care, living arrangements, or specific decisions about their upbringing.

However, before making an application to the court, most people are legally required to attend a Mediation Information and Assessment Meeting (MIAM). A MIAM is designed to explore whether mediation could help resolve your dispute, without the need for court intervention. There are exceptions to this requirement, such as cases involving domestic abuse or child protection concerns, but for most individuals, it is a mandatory step in the process.
WHAT IS A C100 FORM, AND WHERE CAN YOU FIND IT?
The C100 form is used to apply to the court for orders regarding children, such as:

-
Child Arrangements Orders (who the child lives with and how they spend time with each parent).
-
Prohibited Steps Orders (preventing certain actions, like moving the child to another area or school without consent).
-
Specific Issue Orders (resolving specific disputes, such as medical treatment or education decisions).

If you need to access a C100 form, there are two main options:

-
Apply Online: The C100 online application portal allows you to fill in the form digitally, save your progress, and return to it as needed.
-
Download and Print: The form is available for download here. If you're filling it out manually, we recommend printing multiple copies and completing a draft in pencil to allow for edits as you work through the form.
DO YOU NEED HELP COMPLETING THE FORM?
Filling out the C100 form can feel daunting, especially if you’re unfamiliar with legal procedures. Whether you’re handling it on your own or seeking support, there are resources available:

-
Legal Advisors: Hiring a professional to assist you with completing the application can save time and reduce stress. They can provide tailored advice and ensure your form is filled out correctly.

-
Support Through Court (STC): This independent charity offers free, practical assistance for individuals who don’t have legal representation. Their services include:
-
Explaining how the court process works
-
Helping you complete forms, organise paperwork, and prepare your case
-
Providing emotional support by accompanying you to court if needed.
-
While STC cannot provide legal advice or representation, their guidance can make the process far more manageable. Find your nearest STC branch here.
HOW MUCH DOES IT COST TO APPLY?
The application fee for a court order is £232.
However, you may qualify for assistance with court fees if you’re on a low income or receiving certain benefits. To find out if you’re eligible, visit the Help with Court Fees section on the government website.
WHY IS A MIAM IMPORTANT?
Before submitting a C100 application, most people must attend a Mediation Information and Assessment Meeting (MIAM). A MIAM is an initial meeting with a mediator where:

-
You’ll receive information about mediation and other family dispute resolution options.
-
The mediator will assess whether mediation is appropriate for your situation.

Mediation offers a cost-effective, and quicker alternative to court proceedings. It allows both parties to communicate openly, identify shared concerns, and work together to find a resolution.

Some common exceptions to attending a MIAM include:

-
Cases involving allegations of domestic abuse or child protection concerns
-
Emergency applications or situations where a party is unreachable.

Even if mediation isn’t suitable for your case, attending a MIAM ensures you’ve fulfilled the legal requirement before applying to court.
